EPRA pays the utmost care and attention to the materials placed on its database at https://www.epra.com/sustainability/sbpr-data-tool as well as the associated published research, policies, recommendations and guidance (all together the “Database”). Nevertheless, EPRA cannot exclude the possibility that the Database may contain flaws or incorrect or incomplete content. EPRA provides the Database on an 'as is' basis and makes no representations or warranties of any kind with respect to the Database or its contents and disclaims all such representations and warranties. In addition, EPRA makes no representations or warranties about the accuracy, completeness, or suitability for any purpose of the information and related graphics published in the Database. All liability of EPRA howsoever arising from any such inaccuracies or errors is expressly excluded to the fullest extent permitted by law. The use of the Database is not intended to be a replacement or substitute for professional or accounting advice. Neither EPRA nor any of its directors, employees or other representatives will be liable for any loss or damage arising out of or in connection with the use of distribution of or the reliance on the Database. This is a comprehensive limitation of liability that applies to all damages of any kind, including (without limitation) compensatory, direct, indirect or consequential damages, loss of data, income or profit, loss of or damage to property and claims of third parties. Commercial use
The Database is made available by EPRA for use by its members on a non-commercial basis as part of their internal day-to-day business activities. The Database may not be used for any “commercial activity” whatsoever. A “commercial activity” is any use by a third party of the Database or its contents for the purpose of generating revenue or income. Commercial activities include, but are not limited to, using the Database or its contents to structure a product, service or offering for further sale in the market, creating commercial benchmarks, commercial indices, commercial ESG reports & studies (other than purely academic studies) and commercial ESG ETFs. The use of the Database or its contents for any commercial activity requires an additional and separate “for commercial use” licence from EPRA which must be in place prior to the commencement of any commercial activity. The use of the Database or its contents for a commercial activity in the absence of such “for commercial use” licence would constitute a breach of EPRA’s terms and conditions and an infringement of EPRA’s intellectual property rights. No content of the Database can be distributed to third parties that are not EPRA members. EPRA reserves the rights to take appropriate legal action in respect of any such unauthorised use.
