Terms & Conditions
General
1.1 These terms and conditions form the basis of the Agreement between the participants at EPRA Annual Conference 2012 (hereinafter “EPRA Conference”) and EPRA. EPRA will not enter into, accept or sign any third party’s terms and conditions.
1.2 Please read the following terms and conditions which relate to information regarding participation at the EPRA Conference. By registering participation at the EPRA Conference the participant is agreeing to these terms and conditions. From time to time we may change these terms and conditions and will post revisions on our website, therefore we recommend that you read these terms and conditions regularly.
Participation
2.1 The participant should be an individual representative of an EPRA Member who has been invited by EPRA to attend the EPRA Conference.
2.2 Participation is effective when the online registration is acknowledged and acceptance is confirmed to the participant via email. Participation is offered at the discretion of EPRA, and EPRA has the right to accept or reject any application for participation in its sole discretion.
The participant is required to provide complete and accurate personal information in regards to his/hers professional status for registration or other Conference related purposes. The participant may update the information via the registration coordinators.
2.3 EPRA will protect Participants’ personal data. EPRA will treat data provided by Participants confidentially and solely in compliance with the provisions of the data protection law. Personal data are all data stored in connection with the Participant’s name. EPRA will store the basic data provided by the Participant (title, given name, family name, delivery and invoice address, telephone and fax numbers, e-mail address) in its subscriptions and customer file and will process and use the data and – to the extent necessary – forward it to service providers appointed for the purposes of fulfilling this contract and invoicing.
Participants consent and authorise EPRA to disclose all information provided by them to EPRA including personal information, to its Affiliates, agents, sub-contractors and/or service providers and their staff, employees, officers and agents for the purposes of:
2.3.1 improvement of the quality of services provided to you in relation to this event 2.3.2 improvement of EPRA customer service, by but not limited to means of research, marketing, product development and planning;
2.3.3 Marketing of EPRA and/or its partners products or services; and
2.3.4 Any third party provider of services to EPRA and Participants in connection with the administration of the EPRA Conference.
2.4 Participants must not:
2.4.1 Act in any way which is likely to be detrimental to the interests of EPRA; or
2.4.2 Supply or attempt to supply misleading information, or make any misrepresentation to EPRA or its Affiliates, agents, sub-contractors and/or service providers and their staff, employees, officers and agents; or
2.4.3 Act in any way which in EPRA’s reasonable opinion breaches or is likely to breach these Terms and Conditions or is inconsistent with the implied interpretation of these Terms and Conditions.
2.5 Participants must comply with these Terms and Conditions at all times.
Programme changes
3.1 EPRA reserves the right at all times to make any changes to the EPRA Conference Programme in its sole discretion.
Copyrights
The EPRA Conference documentation is protected by copyright. Duplication, distribution or any other use of the conference documentation is only permitted with the express written consent of EPRA.
Liability
4.1 EPRA Conference is carefully prepared and carried out on the basis of the current level of knowledge. No liability is assumed for advice given, the use made of knowledge acquired during the EPRA Conference or the up-to-dateness, correctness and completeness of the EPRA Conference documentation. EPRA is not responsible and disclaims liability for errors or omissions including (without limitation) those resulting from computer hardware or software errors or failures, or for fraud, or for lost, stolen, or corrupted online registration data or sale reports of Products.
4.2 EPRA is not liable for any special, indirect, consequential damage or loss including loss of profit or loss of business.
Breach of terms & conditions
5.1 Any breach of these Terms and Conditions by a Participant whether intentional or otherwise may result in suspension or termination of participation at the sole discretion of EPRA.
Termination
6.1 EPRA expressly reserves the right to terminate or alter (whether materially or otherwise) the EPRA Conference at any time, without any liability to Participants.
6.2 EPRA reserves the right at any time in its absolute discretion and without notice to suspend or terminate the participation of any Participant, without any liability.
6.3 Participation will terminate automatically on the death of a Participant. EPRA will terminate the Participant’s participation on receipt of notification of the death of the Participant.
Governing Law
7.1 The Terms and Conditions and participation in shall be governed by and construed in accordance with the laws of Belgium. Any dispute arising out of or in connection with these Terms and Conditions, including any question regarding its existence, validity or termination, shall be referred to and finally resolved by arbitration in Belgium. The language of the arbitration shall be English where it is legally acceptable. Notwithstanding the foregoing, nothing herein prevents EPRA from applying to the courts of any country for injunctive or other equitable relief to prevent or curtail any breach of these Terms and Conditions.
7.2 EPRA’s decision on all matters relating to these Terms and Conditions are final and binding on all Participants.
Force Majeure
EPRA shall not be liable in damages for any delay or default in performing hereunder the EPRA Conference if such delay or default is caused by conditions beyond its control such as acts of God (including but not limited to fire, earthquake, hurricane, volcano, flood), government restrictions (including the denial or cancellation of any export of other necessary license), wars, insurrections and/or any other cause beyond the reasonable control of the party whose performance is affected (including mechanical, electronic, or communications failure).
In the event of it being impossible for EPRA to carry out EPRA Conference due to unforeseen events beyond its control, so long as this arises from a cause not attributable to EPRA, EPRA shall only be obliged to reimburse the payments received in regards to EPRA Conference participation subject to deduction of any costs it has incurred in preparing the event. This liability only extends to the payments made directly to the EPRA Conference and not to payments made by the attendees to the hotel or airlines.

Concluding provisions
Should individual provisions of the terms and conditions be legally invalid, the remaining provisions will be binding. Agreements differing from this contract will only be valid when agreed to in writing.
